The name of a victim of sexual conduct whether it has been committed or alleged should not be published in a newspaper in this state. If publication occurs, a fine of no more than $1,000 or three years imprisonment carries.

Exact wording:

“Whoever publishes or causes to be published the name of any person upon whom the crime of criminal sexual conduct has been committed or alleged to have been committed in this State in any newspaper, magazine or other publication shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than one thousand dollars or imprisonment of not more than three years. The provisions of this section shall not apply to publications made by order of court.”

A notice of any kind in terms of gaining compensation on sound recordings that are deemed unlawful will result in punishment provided in the penalties section 1611920.

Exact wording:

“(A) It is unlawful for a person to: (2) advertise, offer for sale or resale, or sell or resell, or cause the sale or resale, or rent or cause the rental of, or possess for any of these purposes any article described in item (1) with the knowledge that the sounds on it have been transferred without the consent of the owner; A person who violates this section, upon conviction, must be punished as provided for in Section 16-11-920.

(B) As used in this section:  (1) “Person” means an individual, partnership, corporation, company, association, any communications media including, but not limited to, radio or television, broadcasters or licensees, newspapers, magazines, or other publications, or media which offer facilities for the purposes stated in this chapter, or other legal entity.”

Publication in effort to return a found handgun

If a handgun is found it should be turned over to law enforcement where there is a ninety day holding period. During the ninety days an advertisement of the description of the handgun should be placed at least twice in a newspaper with general circulation.

“(B) At least twice during the ninety-day holding period, the agency shall advertise the handgun with its full description in a newspaper having general circulation in the county where the handgun was found.”
